Nonexempt workers are covered by the Federal Labor Standards Act (FLSA), which specified minimum wage, overtime rules and record-keeping requirements. Whether an employee is classified as exempt or nonexempt is determined by the FLSA and is based on job responsibilities and salary level. Exempt employees are not covered under the FLSA rules and there are no minimum wage requirements or overtime pay requirements. Exempt employees are typically paid a salary.
